Chapter 64E-9, Florida Administrative Code, is the rule that governs public swimming pools and bathing places in Florida, adopted under Chapter 514, Florida Statutes. If a spa falls inside the definition of a public pool — and many spas people think of as private do — this is the rule that sets its chemistry, its turnover, its safety equipment, and its records. This is the operating reference; the classification question comes first.
Which spas are in scope
The category is broader than “commercial.” Spas serving transient or shared populations are generally treated as public bathing places rather than residential, including:
- Hotel, motel, and resort spas
- HOA and condominium common-area spas
- Multi-unit rental property spas

- Spas at clubs, gyms, wellness facilities, and similar member or public venues

Most operators run 3–5 ppm free chlorine rather than sitting at the 2.0 ppm floor, because a spa can burn through its residual between tests. Always verify current values against the rule text itself before relying on them operationally — administrative code is amended, and the health department's inspection form is the version that counts on the day.
Circulation and turnover
- Turnover:30 minutes maximum for a spa — far faster than any residential pool, because the bather-to-water ratio is an order of magnitude higher. See turnover rate for the calculation.
- Filtration sized to achieve that turnover at the design flow, with the filter rated for the rate it actually runs at.
- Continuous circulation during operating hours. A spa on a residential-style timer schedule will not hold chemistry.
Safety equipment and signage
- Emergency shutoff— a clearly marked stop control within sight and reach of bathers, plus ground-fault protection.

- Depth marker visible from the deck.
- Signage covering hyperthermia warning, maximum bather load, maximum water temperature, emergency shutdown location, and no-lifeguard notice where applicable.

Operator certification
Florida generally requires certified operator oversight for public pool and spa operations. The certified operator does not have to be on site continuously, but must be demonstrably in charge of operations and reachable, and is personally responsible for compliance and the accuracy of the records. Non-certified staff may perform routine work under that supervision.

Records
The daily log is the part of compliance that gets neglected and the part inspectors look at first. At minimum, per day of operation: chemistry readings with times, chemicals added, bather counts, equipment issues, and any incident with its corrective action and closure/reopening times. Retain them for the period the health department requires.

Chemistry inside a tighter band than a homeowner keeps, a 30-minute turnover, working safety equipment, and a log written the day it happened. Facilities that fail usually fail on the log and the signage, not the water.
